Terms of Service

These Terms of Service ("Terms") govern your use of the FREE60 mobile application (the "App") operated by FREE60 ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that:

• You are at least 16 years of age
• You have the legal capacity to enter into a binding agreement
• You agree to comply with these Terms and our Privacy Policy

If you do not agree to these Terms, do not use the App.

2. Description of Service

FREE60 is a personal diagnostic system that measures the structural stability of your life across three dimensions: Health, Wealth, and Capacity. The App:

• Integrates with Apple Health to read health and fitness data
• Accepts manually entered data for non-automated KPIs
• Calculates KPI scores, lever scores, dimension scores, and a composite Freedom Index
• Provides AI-generated insights based on your data patterns
• Tracks trends over time and surfaces cross-dimensional signals

3. Account Registration

• You must create an account to use the App
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate and complete information during registration
• You must promptly update your account information if it changes
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscriptions and Payments

4.1 Subscription Plans

The App may offer free and paid subscription tiers. Paid subscriptions unlock additional features as described in the App.

4.2 Billing

• Subscriptions are billed through Apple's App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• All billing, refunds, and payment disputes are managed by Apple under their terms and conditions

4.3 Auto-Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings

4.4 Free Trials

• If offered, free trials automatically convert to paid subscriptions unless canceled before the trial ends
• Any unused portion of a free trial is forfeited when you purchase a subscription

4.5 Refunds

Refund requests must be directed to Apple through their standard refund process. We do not process refunds directly.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App, other accounts, or our systems
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute the App or its content
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's infrastructure
• Impersonate another person or entity
• Upload malicious code or content
• Use the App to harass, abuse, or harm others
• Resell, sublicense, or commercially exploit the App

6. Health Data and Medical Disclaimer

6.1 Not Medical Advice

The App is a measurement and visibility tool. It is not a medical device, diagnostic tool, or substitute for professional medical advice.

• KPI scores, trends, and AI insights are informational only
• Nothing in the App constitutes a diagnosis, treatment recommendation, or medical opinion
• Sleep, HRV, heart rate, and activity data are processed for pattern detection, not clinical assessment
• Do not make medical decisions based on information from the App
• Always consult a qualified healthcare provider for medical concerns

6.2 Not Financial Advice

The wealth dimension tracks financial structure and patterns. It is not financial advice.

• Income, expense, investment, and liquidity scores reflect structural patterns, not portfolio recommendations
• Nothing in the App constitutes investment advice, tax guidance, or financial planning
• Always consult a qualified financial advisor for financial decisions

6.3 Accuracy

While we strive for accuracy, we do not guarantee that scores, calculations, or AI insights are error-free. Data from Apple Health depends on the accuracy of your devices and sensors. Manually entered data depends on your input accuracy.

7. AI-Generated Content

• The App uses artificial intelligence to generate insights from your data
• AI-generated content is probabilistic and may contain errors, inaccuracies, or irrelevant observations
• AI insights do not constitute professional advice of any kind (medical, financial, psychological, or otherwise)
• You should not rely solely on AI-generated content for important decisions
• We are not liable for actions taken based on AI-generated content

8. Intellectual Property

8.1 Our Property

The App, including its code, design, content, scoring methodology, KPI framework, dimension structure, and brand assets, is the intellectual property of FREE60. All rights are reserved.

8.2 Your Data

You retain ownership of all data you provide to the App. By using the App, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the App's functionality to you.

8.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us an unrestricted, irrevocable, perpetual license to use that feedback for any purpose without compensation.

9. Third-Party Services

The App integrates with third-party services:

• Apple HealthKit: Governed by Apple's terms and privacy policies
• Firebase (Google): For authentication and data storage
• OpenAI: For AI insight generation (aggregated scores only)
• Apple App Store: For subscription billing

We are not responsible for the practices, content, or availability of third-party services. Your use of third-party services is governed by their respective terms.

10. Availability and Modifications

• We do not guarantee uninterrupted or error-free access to the App
• We may modify, update, or discontinue features at any time
• We may perform maintenance that temporarily affects availability
• We will make reasonable efforts to notify users of significant changes
• We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance

11. Termination

11.1 By You

You may stop using the App and delete your account at any time. Account deletion removes your data in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or harmful activity
• Abuse the App's infrastructure
• Fail to pay for subscription services

11.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Provisions that by their nature should survive (including Sections 6, 7, 8, 12, 13, and 14) will survive termination

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE APP WILL MEET YOUR REQUIREMENTS
• THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• RESULTS OBTAINED FROM THE APP WILL BE ACCURATE OR RELIABLE
• ANY DEFECTS WILL BE CORRECTED

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FREE60 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:

• YOUR USE OF OR INABILITY TO USE THE APP
• ANY CONTENT, DATA, OR INSIGHTS PROVIDED BY THE APP
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• ANY THIRD-PARTY CONDUCT ON THE APP

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless FREE60 and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you provide through the App

15. Governing Law and Disputes

• These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles
• Any disputes arising from these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• Arbitration shall take place in Delaware or remotely at your election
• You waive the right to participate in class actions or class arbitrations
• Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property disputes

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FREE60 regarding the App. They supersede all prior agreements, representations, and understandings.
